§ 1042.05 PRIVATE DISPOSAL SYSTEMS.
   (a)   Except as hereinafter provided, no person shall construct or maintain any privy, privy vault, septic tank, cesspool or other facility intended or used for the private disposal of sewage.
   (b)   Where a public sanitary sewer is not accessible to a premises, the building sewer shall be connected to a private sewage disposal system according to the following provision.
      (1)   The type, capabilities, location and layout of a private sewage disposal system shall comply with all requirements of the local health authority and all recommendations of the OEPA. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than 15,000 square feet in cases where an approved public water supply is available, and 31,500 square feet in cases where the water supply must be obtained from a well on the same lot. No holding tank waste shall be permitted to discharge into any natural outlet.
      (2)   No person shall directly or indirectly discharge holding tank waste into a public sewer unless a permit therefor is secured from the Director of Public Works and Services. Unless allowed by the terms and conditions of the permit, a separate permit shall be secured for each separate discharge. Such permit shall specify the location of the discharge, the time of the day the discharge is to occur, the volume of the discharge and its constituents. If a permit is granted for the discharge of wastes into a public sewer, the user shall pay the applicable user charges and fees and shall meet any other conditions required by the Director.
      (3)   The owner shall, at his or her expense, operate and maintain the private sewage disposal facilities in a sanitary manner at all times.
   (c)   Where it is necessary to install a private sewage disposal system to serve a premises and a public sewer becomes available to that premises by means of main or lateral sewers, the premises shall, as soon as practical, be connected to the public sewer. Any septic tanks, cesspools or similar private sewage disposal facilities shall be abandoned and filled with suitable materials.
