§ 1022.07 AWNINGS, MARQUEES AND CANOPIES OVER SIDEWALKS.
   (a)   No person shall erect an awning, marquee or canopy over a city sidewalk without first obtaining a permit therefor from the office of the Director of Public Works and Services.
   (b)   (1)   Such permit shall be issued to any person applying therefor, provided that the application indicates that the awning, marquee or canopy will be at least eight feet in height at all locations, that the structure will not be built any closer than five feet from the curbing or street line and that a state building permit has been obtained for such construction.
      (2)   The Director or his or her employees shall reject any such application that does not provide the necessary information to ensure that such awning, marquee or canopy has sufficient structural soundness to ensure the safety of pedestrians using the sidewalk and that the design of the awning, marquee or sidewalk is in conformity with the surrounding structures as recommended for uniformity in the downtown area.
   (c)   The city will charge no fee for the permit.
   (d)   The rejection of an application by the Director may be appealed to a committee of residents composed of a retail merchant, a landlord and a building contractor. Such committee shall be appointed by the Mayor and confirmed by Council, and members shall serve for terms of four years.
