(a) No person, not a resident of the City of Ironton, shall drop, discard, place or deposit litter, garbage, trash, refuse or rubbish in the alleys, streets or ways of the City of Ironton.
(b) The definitions of litter, garbage, refuse and rubbish shall be considered as set forth in § 660.16 of the Codified Ordinances of the City of Ironton as amended.
(c) It shall be no defense that such deposit was made with the consent of a resident of the City of Ironton or that such deposit was made in a proper litter receptacle or garbage container.
(d) Any person who violates this section is guilty of illegal dumping, a misdemeanor of the third degree, punishable by not more than 60 days imprisonment and a fine of not more than five hundred dollars ($500.00). The sentencing court may in addition to or in lieu of the penalty provided herein, require a person who violated this section to remove such illegal deposit.
