(a) Minors under thirteen. No minor under the age of 13 years shall loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between 9:00 p.m. and dawn of the following day. However, this division does not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.
(b) Minors between thirteen and eighteen. No minor under the age of 18 years and over the age of 13 years shall loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between 12:00 midnight and dawn. However, this division does not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.

(c) Disposition of minor. Any minor found in violation of this section shall be taken to the Police Department and the parent, guardian or person in loco parentis shall be notified to come to the Department and take personal charge of the minor. The minor shall be released only to the parent, guardian or person in loco parentis or to the juvenile authorities.
(d) Responsibility of parents.
(1) No parent, guardian or other person having the lawful care, custody or control of any minor under the age of 18 years shall knowingly allow or permit such minor to violate division (a) or (b) hereof.
(2) It shall be prima-facie evidence of a violation of this division if the child of a parent, guardian or person having lawful custody is found in violation of this section.
(3) Whoever violates this division is guilty of a minor misdemeanor and shall be subject to the penalty provided in § 698.02.
