All persons holding office or employment at the time this Charter takes effect shall continue in office and in the performance of his duties until provision shall have been made, in conformity with the Charter, for the performance of such duties by a successor, or the office or employment is abolished. The members currently serving on all boards and commissions shall continue to serve until their term expires, whereupon they shall be replaced or reappointed in accordance with the provisions of this Charter.
All contracts entered into by the City or for its benefit prior to the taking effect of this Charter, shall continue in full force and effect. Public improvements for which legislative steps have been taken under laws existing at the time this Charter takes effect shall be completed, as nearly as practicable, under the provisions of such laws.
No action or proceeding, civil or criminal, pending at the time this Charter shall take effect, brought by or against the Municipality or any office, agency or officer thereof, shall be abated or affected by anything herein contained, but all such actions shall be prosecuted or defended under the laws in effect when they were filed.
The Charter shall go into effect, for the purpose of electing the first Council and Mayor hereunder, on November 4, 1980. The first Council and Mayor shall be nominated and elected under the provisions of this Charter, the election being held November 4, 1980. At the first election the four candidates receiving the highest number of votes for Council shall be elected to serve through December 1, 1985, and the three remaining successful candidates shall serve through December 1, 1983. The current Council members’ terms shall cease and terminate on December 1, 1980, at which time the first Council elected under this Charter shall take office. The person receiving the highest number of votes for Council shall serve as Vice Mayor from December 1, 1980, to December 1, 1985, whereupon he shall be succeeded by the person receiving the highest number of votes for Council in the November, 1983, election, in accordance with the provisions in this Charter. The Mayor elected on November 4, 1980, shall hold office through December 1, 1983. For all purposes other than election of the first Council and Mayor, this Charter shall take effect and be in full force from July 4, 1980.
