The city council may, by resolution, establish fees and assess costs against involved parties related to the response to any hazardous materials incident or transportation related incident. In the case of hazardous materials incidents, the costs will be assessed against the party who brought the hazardous materials to the scene, regardless of which party caused the need for emergency response. In the case of transportation related incidents, costs will be assessed against the owner and/or operator of the motor vehicle requiring emergency response. (Ord. 10-4380, 1-25-2010)
