3-4-1: DEFINITIONS:
   ADMINISTRATOR: The village president or his or her designee authorized to administer the franchise for the village.
   AGENCY: The solid waste agency of northern Cook County.
   APPROVED CONTAINERS: Approved containers to be used for the pick up of compostable materials shall be thirty (30) gallon kraft type disposable bags, or bundles as hereinafter described, but each such bag and bundle in excess of two (2) per pick up day shall each have a prepaid sticker attached. Approved thirty five (35) gallon, sixty five (65) gallon or ninety five (95) gallon toter recycling containers as designated by the franchise agreement shall be used for the pick up of recyclable materials. Approved containers for garbage shall be a franchisee supplied sixty five (65) gallon or ninety five (95) gallon toter for single-family and single-family detached condominium/townhomes. Multi-family homes shall use only a central collection point authorized by the village administrator.
   COMMODITY: A material that can be sold in a spot or future market for processing and use or reuse.
   COMPOSTABLE MATERIAL, OR COMPOSTABLES: Grass, garden clippings, weeds, bushes and leaves, brush clippings, branch clippings, tree limbs less than six inches (6") in diameter, and other materials accumulated as a result of the care of lawn, shrubbery, vines and trees, providing all such materials are placed in prepaid bags as hereinafter described and not commingled with "garbage" or "recyclable materials" as herein defined, provided, however, branches and sticks not exceeding one and one-half inches (11/2") in diameter shall be tied in bundles not exceeding four feet (4') in any length and two feet (2') in diameter.
   CONTRACTOR: Groot Recycling And Waste Services, Inc.
   CURBSIDE: The approved point of collection which shall be within five feet (5') of the edge of the paved street.
   DISPOSAL SITE: A refuse depository including, but not limited to, sanitary landfills, transfer stations, incinerators and waste processing/separation centers licensed, permitted or approved by all governmental bodies and agencies having jurisdiction and requiring such licenses, permits or approvals to receive garbage and refuse for processing or final disposal.
   FRANCHISE AGREEMENT: That exclusive franchise agreement as defined in section 3-4-5 of this chapter.
   FRANCHISEE: The village's exclusively franchised private contractor to provide waste disposal services to all occupied residential units within "the village" (as defined in this section) authorized by the franchise agreement between the village of Inverness and Groot Recycling and Waste Services, Inc., which became effective on October 1, 2006.
   GARBAGE OR REFUSE: Shall include the accumulation of animal, fruit, fish, fowl, vegetable matter resulting from the preparation, use or cooking of food for household consumption. Said residential garbage shall be wrapped in paper or equivalent. Refuse shall also include household rubbish generally exclusive of dirt, and any refuse resulting from the commercial repair or remodeling of buildings. Excluded from the definition of "refuse" are "white goods", as defined by the Illinois EPA, tires and batteries and such other items as may be identified by the village or SWANCC from time to time.
   HAZARDOUS WASTE: Waste, in any amount, which is defined, characterized or designated as hazardous by the United States environmental protection agency or appropriate state agency by or pursuant to federal or state law, or waste, in any amount, which is regulated under federal or state law. For purposes of this code, the term "hazardous waste" shall also include motor oil, gasoline, paint and paint cans.
   LANDSCAPE WASTE: See definition of Compostable Material, Or Compostables.
   MUNICIPAL WASTE SYSTEM: The waste collection, transportation and disposal system of the village operated under licenses issued pursuant to section 3-4-4 of this chapter, including all physical assets of the village used for the collection, transportation and disposal of system waste, all amounts on deposit in the municipal waste system fund and all amounts collected on account of rates and charges imposed under this code.
   NONSYSTEM WASTE: Any waste, garbage, or refuse excluded from the waste system, including, but not limited to, hazardous waste, toxic waste, medical waste, or refuse resulting from the commercial repair or remodeling of any buildings and debris removed from the site of new construction prior to the issuance of any occupancy permit.
   NONSYSTEM WASTE HAULER: Any carrier, hauler, scavenger of or dealer in nonsystem waste.
   PERSON: Any natural individual, firm, trust, estate, partnership, association, joint stock company, joint venture, or corporation, or a receiver, trustee, conservator or other representative appointed by order of any court.
   PRODUCER: An occupant of a residential unit who generates residential refuse and recyclable materials and places commodities at the curb prepared for recycling.
   PROJECT USE AGREEMENT: The 1992 project use agreement by and between the village and the agency, as amended from time to time.
   RECYCLABLE MATERIALS: Those commodities which are collected under the franchise agreement which shall include newspaper, mixed papers (junk mail, chipboard, white and colored paper, brown kraft paper bags), corrugated cardboard, magazines, aluminum cans, tin, steel and/or bimetal cans, clear, green and brown glass bottles and jars, #1 PETE plastic containers and #2 HPDE plastic containers, #3-#7 plastic containers and bags, aseptic beverage containers, 6-pack rings, 12-pack bands, and any other material, items or commodities mutually agreed upon by the village and the franchisee to be included as a "recyclable material" subsequent to the execution of the franchise agreement.
   RECYCLING CONTAINERS: The container provided by the village or its franchisee to residents for the specific purpose of storing recyclable materials on site and for placing those materials curbside for collection. Exact size, shape and color of said container may vary from time to time, however, recycling containers will be clearly marked for use as a recycling container only. Effective October 1, 2006, the recycling container shall be a thirty five (35) gallon, sixty five (65) gallon or ninety five (95) gallon toter container as designated by the franchise agreement and as provided by the franchisee to each residential unit.
   RECYCLING SERVICES: An organized program sponsored by the village resulting in residents within the corporate limits separating recyclable and compostable materials and placing them curbside or at the designated trash collection point to be collected by the village or the village's exclusively franchised private contractor (the franchisee).
   RESIDENTIAL REFUSE: All garbage and rubbish generated by a producer at a residential unit.
   RESIDENTIAL UNIT: A single-family unit within the corporate limits of the village. An existing residential unit shall be deemed occupied when either water or domestic light and power service are being supplied thereto. For new construction, a residential unit shall be deemed occupied when an occupancy permit, either temporary or final, has been issued for such unit. A condominium dwelling, whether of single- or multi-level construction, shall also be treated as a residential unit, except that each single-family dwelling within any such residential unit shall be counted separately as a residential unit. Payments by customers to the franchisee for service may be abated due to lack of occupancy only to the extent mutually agreed upon by the village and the franchisee.
   SWANCC: The solid waste agency of northern Cook County.
   SYSTEM WASTE: Residential refuse discarded by persons within the corporate limits of the village. System waste does not include hazardous waste, toxic waste or medical waste. System waste shall also not include recyclables or compostable materials, both of which shall be as designated by the village from time to time.
