ADOPTING ORDINANCE
ORDINANCE NO. 00-666
AN ORDINANCE RE-ADOPTING AND RE-ENACTING THE VILLAGE OF INVERNESS VILLAGE CODE AND ADDING A NEW SECTION 1-1-5 THERETO
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF INVERNESS, COOK COUNTY, ILLINOIS, in exercise of the authority of this Village as a Home Rule Unit, as follows:
SECTION 1: The Village of Inverness Village Code, consisting of Titles 1 through 11, inclusive, in the form attached hereto, is hereby re-adopted and re-enacted as the "Inverness Village Code" (hereinafter "said Code" or "the Code"), and shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances of the Village passed on or before May 9, 2000, as specified in said Code, except such as by reference thereto in this Ordinance or in said Code are expressly saved from repeal or continued in force and effect for any purpose.
SECTION 2: Any and all additions or amendments to said Code, when passed in such form as to indicate the intention of the President and Board of Trustees to make the same a part thereof, shall be deemed to be incorporated into said Code so that reference to the "Inverness Village Code" shall be understood and intended to include such additions and amendments thereto.
SECTION 3: At least one (1) copy of said Code shall be kept on file in the Office of the Village Clerk, preserved in looseleaf form. It shall be the express duty of the Village Clerk, or someone authorized by him or her, to insert in at least one copy in their designated places all amendments or ordinances which indicate the intention of the President and Board of Trustees to make the same a part of said Code when the same have been printed or reprinted in page form, and to extract from said Code all provisions which may from time to time be repealed by the President and Board of Trustees. This amended copy of said Code shall be available for all persons desiring to examine the same and shall be considered the official Inverness Village Code.
SECTION 4: In case any section of said Code, or any amendment thereto, for which a penalty is not provided, the general penalties as provided in Chapter 4 of Title 1 of said Code shall apply to the section or the section as amended or in case such section or amendment contains provisions for which a specific penalty other than the aforementioned general penalty is provided in another section in the same chapter as such section or amendment thereto, the specific penalty so provided in such other section shall be held to relate to the section, or amendment thereto, unless such penalty is specifically repealed therein.
SECTION 5: This Ordinance shall not affect any punishment or penalty or any action based on any general and permanent ordinance of the Village superseded by this Ordinance incurred before the effective date of this Ordinance, nor any suit, prosecution or proceeding pending at the time of the effective date of this Ordinance for any offense committed or cause of action arising before the effective date of this Ordinance and said prior general and permanent ordinances as heretofore existing shall continue in full force and effect for said limited purpose.
SECTION 6: The Code hereby re-adopted is intended to codify and thereby supersede all general and permanent ordinances of the Village of Inverness passed on or before May 9, 2000, and to the extent that any general and permanent ordinance of the Village has not been included in said Code, by oversight or otherwise, said omitted ordinance(s) shall continue in full force and effect until their inclusion herein.
SECTION 7: A new Section 1-1-5 is hereby added to the Inverness Village Code which Section shall read as follows:
"1-1-5: This Village Code has been re-adopted by the President and Board of Trustees of the Village of Inverness effective May 19, 2000 in exercise of the authority of the Village of Inverness as a Home Rule municipality."
SECTION 8: If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance, or any part hereof. The President and Board of Trustees hereby declare that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional, invalid, or ineffective. The President and Board of Trustees do hereby expressly exercise the Home Rule Authority of the Village of Inverness to waive, vary, cure and/or otherwise remove any procedural defect or technical deficiency in the proceedings relative to the adoption of this Ordinance.
SECTION 9: This Ordinance shall be in full force and effect on May 20, 2000, which date is not less than ten (10) days from and after its passage, approval and publication in pamphlet form pursuant to law.
SECTION 10: The Village Clerk is hereby authorized and directed to publish this Ordinance and the Inverness Village Code hereby re-adopted in book or pamphlet form.
Presented, read and passed by the President and Board of Trustees of the Village of Inverness, Cook County, Illinois, on a roll call vote at a duly called regular or special meeting of the Board of Trustees on the 9TH day of May, 2000, and deposited and filed in the Office of the Clerk of said Village on said date.
