11-1-2: SPECIAL SIZE, WEIGHT, AND LOAD RESTRICTIONS:
   A.   Special Axle Load and Gross Weights: No vehicle or combination of vehicles, regardless of number of axles, shall exceed a maximum weight of ten thousand (10,000) pounds, whether said vehicle or combination of vehicles is unladen or with load, on the following streets, provided that such limitations shall only be effective when signs are erected giving notice thereof:
Ardmore Avenue, from Williams Road east to its terminus.
Arlington Road, from Wood Street to Florence Avenue, and from Palatine Road south to Ardmore Avenue.
Bradwell Road, from Jules Road to its terminus east of Ela.
Canterbury Lane, from Ela Road to the cul-de-sac at its terminus.
Florence Avenue, from Ela Road to Williams Road.
Haman Road, from Wood Street to Baldwin Road, and from Palatine Road south to its terminus.
Harmening Avenue, from Poteet Avenue to Roberts Road.
Jules Road, from Wood Street to Bradwell Road.
Poteet Avenue, from Wood Street to its terminus north of Bradwell, and from Palatine Road south to Freeman Court.
Roberts Road, from Wood Street to its terminus north of Bradwell, from
Florence Avenue to Baldwin Road, and from Palatine Road south to its terminus.
Rosemary Avenue, from Haman Road to Williams Road.
Stratford Lane, from Canterbury Lane to Roberts Road.
Sunset Drive, from Ela Road west to its terminus.
Warren Avenue, from Roberts Road east to its terminus.
Willow Street, from Jules Road to Haman Road.
Windsor Lane, from Florence Avenue to Canterbury Lane.
Wood Street, from Jules Road to Roberts Road.
Said weight limitations shall not apply to vehicles operated by a public utility when required for the installation or repair of public service facilities or properties, and shall not apply to fire apparatus, equipment designed for snow and ice removal, garbage or refuse equipment, moving vans or trucks with a delivery or pickup destination on such street, school buses picking up or discharging passengers on such streets, or vehicles operating under a special permit as provided in this Section.
   B.   Temporary Prohibition of Certain Classes of Vehicles:
      1.   Whenever any highway or road, or parts thereof, under the jurisdiction of this Village, by reason of deterioration, rain, snow or other climatic conditions, will be seriously damaged or destroyed by the use of trucks or other commercial vehicles in excess of a certain maximum weight whether unladen or with load, as determined by the Village Administrator, the operation of said vehicles thereon shall be prohibited.
      2.   The Village President is hereby authorized to determine and designate the time and the highways or roads, or parts thereof, which shall be so seriously damaged or destroyed as above provided, and shall so advise the Board of Trustees of the Village. The Board of Trustees, by resolution, may prohibit the operation of trucks or other commercial vehicles which are in excess of said maximum weight over and upon such roads or highways, or parts thereof, so designated, provided that said prohibition shall not exceed ninety (90) days in any one calendar year.
      3.   If the Village President shall determine that any roads or highways, or parts thereof, might suffer serious damage prior to the time in which the Board of Trustees could meet for the purpose of taking remedial action as provided above, then in such emergency the Village President, or in his absence, President Pro Tem, may act alone in prohibiting the operation of trucks or other commercial vehicles which are in excess of a certain maximum weight, based on the recommendation of the Chief of Police or Village Engineer, over and upon such roads or highways, or parts thereof, and may direct the erection of signs at each end of such road or highway, or parts thereof, affected thereby. The Board of Trustees, at its next regular meeting called after action taken by the Village President as provided above, shall either confirm said action by resolution and extend said prohibition for a period not to exceed ninety (90) days (including within such 90 days the period covered by such emergency action), or, by resolution, direct that the signs be removed and declare that no emergency exists.
   C.   Applications for Special Permits:
      1.   Each vehicle exceeding the size, weight and load limitations of this Chapter may be operated on the roads and streets under the jurisdiction of the Village only with a police escort and special written permit issued by the Village President.
      2.   Application for such a special permit shall be made in writing to the Police Department, and shall:
         a.   State if the applicant is an authorized carrier under the Illinois Motor Carrier of Property Act; if so, his certificate, registration or permit number issued by the Illinois Commerce Commission;
         b.   Specifically describe the vehicle or vehicles and the load to be operated or moved, and whether such permit is requested for a single trip or for limited continuous operation;
         c.   State the points of origin and destination of the vehicle or vehicles to be operated under the special permit;
         d.   State if the vehicles or loads will be transported for hire.
   D.   Issuance of Special Permits: The Village President is authorized to issue permits hereunder subject to the following conditions:
      1.   No such permit shall be issued until the applicant shall have supplied the Village President with a surety bond to compensate for any injury to any road or road structure. The form of bond and the surety shall be approved by the Village President. The amount of said bond shall be determined by the product of five thousand dollars ($5,000.00) multiplied by the number of miles the vehicle, or vehicles, propose to travel on the Village roads or streets.
      2.   In establishing the routes to be traveled, the Chief of Police shall establish the most direct and shortest route consistent with the public safety, and take into consideration existing traffic, the character of the road or roads, and the configuration of the terrain.
      3.   Every permit shall be in writing and shall be carried in the vehicle or one of a combination of vehicles to which it refers, and shall be open to inspection by any police officer or authorized agent of the Village. (1983 Code)
      4.   The Village President, or his or her designee, shall report the number and nature of all permits issued each month to the Board of Trustees.
   E.   Fees For Special Permits:
 
Single trip permits   
$10.00
Limited continuous operation permits; for a period not to exceed 30 days   
$25.00
Limited continuous operation permits; for a period not to exceed 60 days   
$50.00
 
In addition, a fee shall be charged for police escorts based upon the hourly rate charged for police services under any then current intergovernmental agreement for cooperative police services to which the village is a party, based upon an estimate of the time of movement prepared by the chief of police or his representative at an assumed speed of fifteen (15) miles per hour. Payment of fees authorized by this section shall be made to the village collector. No permit shall be issued until such fee has been paid, and no refund shall be made to applicant following the issuance of a permit if the move is not completed. (Ord. 92-468, 12-8-1992)
   F.   Weighing Of Vehicles And Removal Of Excess Loads:
      1.   Any police officer having reason to believe that the weight of a vehicle and load is unlawful shall require the driver to stop and submit to a weighing of the same either by means of portable or stationary scales. If such scales are not available at the place where such vehicle is stopped, the police officer shall require that such vehicle be driven to the nearest public scales.
      2.   Whenever an officer upon weighing a vehicle and load as above provided, determines that the weight is unlawful, such officer shall require the driver to stop the vehicle in a suitable place and remain standing until such portion of the load is removed as may be necessary to reduce the gross weight of such vehicle to such limit as permitted under this section, and shall forthwith arrest the driver. All material so unloaded shall be cared for by the owner or operator of such vehicle at the risk of such owner or operator.
      3.   Any driver of a vehicle who fails or refuses to stop and submit the vehicle and load to a weighing, or who fails or refuses when directed by an officer upon weighing of the vehicle to otherwise comply with the provisions of this section, shall be guilty of a violation hereof. (1983 Code)
