9-1-2: AIR POLLUTION:
   A.   The corporate authorities find that pollution of the air constitutes a menace to public health and welfare, creates public nuisances and offends the senses.
   B.   Subparagraphs (a) and (c) of paragraph 1009 of the EPA are hereby adopted by reference as part of this chapter, except in subparagraph (a), delete the word "Illinois" and all words following and add "Inverness"; and in subparagraph (c) delete the word "Agency" and all words thereafter and add "Environmental Protection Agency of the State of Illinois".
   C.   In addition to the above, no person shall:
      1.   Burn or allow to be burned any coal as the principal source of heat of any building.
      2.   Conduct any business or use any premises or allow any business to be conducted or any premises to be used to release noxious, offensive, unwholesome or disagreeable odors into the atmosphere.
      3.   Burn outdoors any material or landscape waste, or any other organic material of any kind, or rubbish, junk or trash of any kind at any time.
      4.   Build, light or permit any fire so close to a building or structure as to cause danger thereto, or under any other circumstances where there is a danger of the fire spreading.
      5.   Build, light or permit any fire on any public street or sidewalk or within any right of way which has been dedicated or offered for dedication to the village at any time.
   D.   Notwithstanding the above, permits for variances may be granted by the corporate authorities, provided that a permit, waiver or exemption for such variance be first secured from the environmental protection agency of the state of Illinois or from any agency or board acting under the authority of the environmental protection agency.
   E.   The following activities are not in violation of this section:
      1.   The setting of fires to combat or limit existing fires, when reasonably necessary in the judgment of the responsible government officials.
      2.   The burning of fuels for legitimate campfire, recreational and cooking purposes, or in indoor domestic fireplaces in areas where such burning is consistent with other laws, provided that no garbage shall be burned in such areas.
      3.   Small open flames for heating tar, for welding, acetylene torches, highway safety flares and the like. (Ord. 89-353, 6-13-1989)
