A. The removal, cutting, and/or other destruction of any protected private tree, and/or regulated activity otherwise adversely affecting any protected private tree, without a tree permit shall result in a fine equal to one hundred dollars ($100.00) per inch of dbh.
B. Any other violation of this chapter shall result in a fine of not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00) for each offense. Each day that a condition continues in violation of the provisions of this chapter shall be deemed a separate offense.
C. In the event that any person undertakes any removal, cutting and/or other destruction of, and/or regulated activity otherwise adversely affecting any tree without a permit due to emergency circumstances, the village board shall have the authority to waive any penalty or to issue a tree permit after the fact of such cutting or destruction.
