6-2-4: DEFINITIONS:
   ACCEPTED PUBLIC STREET: Any street duly accepted by the Board of Trustees for maintenance by the Village.
   ALLEY: A public right of way, not less than twenty feet (20') nor more than forty feet (40') wide, designed to provide access to the rear or side of properties whose principal frontage is on some other street.
   APPROVED STREET: Any street, whether public or private, meeting standards and specifications of the Village.
   BUILDING LINE: A line within a lot or other parcel of land, so designated on the plat of the proposed subdivision.
   COLLECTOR or SECONDARY STREETS: Those existing streets designated as such on the Official Comprehensive Plan of the Village, and those streets proposed as collector streets in new subdivisions, as shown on the Official Comprehensive Plan, for the purpose of providing arteries for the access of traffic from several minor streets to a major street.
   COMMISSION: In this Title, the word "Commission" shall refer to the Plan Commission of the Village.
   COMPREHENSIVE PLAN: The Official Comprehensive Plan of the Village of Inverness prepared by the Plan Commission and adopted by the Board of Trustees.
   CROSSWALKWAYS: A strip of land dedicated to public use and located across a block to provide pedestrian access to adjacent areas.
   CUL-DE-SAC: A street accessible from only one direction whose terminal end is broadened into a circular vehicle turn around.
   EASEMENT: A grant by a property owner for the use of a strip of land by the general public, a corporation or a certain person or persons for a specific purpose or purposes.
   FINAL PLAT: The drawings and documents described in Chapter 3 of this Title.
   FRONTAGE: The length of the front property line of the lot, lots or tract of land abutting a public street, road or highway.
   GENERAL DEVELOPMENT PLAN: That part of the Official Comprehensive Plan of the Village which defines the existing or proposed primary and secondary streets and roads in and around the Village.
   GRADE: The slope of a road, street or other public way, given as a percent and shown on street profile plans as required herein.
   IMPROVEMENT, PUBLIC: Any sanitary or storm sewer, drainage ditch, water main, roadway, parkway, sidewalk, pedestrian way, planting strip, off-street parking area or other facility for which the Village or some other public body will assume the responsibility for maintenance and operation.
   LOT: A portion of a subdivision or other parcel of land intended for transfer of ownership or for building development.
   MAJOR STREET: See Primary Street.
   MINOR STREET: A street intended primarily as access to abutting properties.
   OWNER: Any person, group of persons, firm or firms, corporation or corporations, or any other legal entity having legal title to the land sought to be subdivided under this Title.
   PARKWAY: An unpaved strip of land situated within the street.
   PEDESTRIAN WAY: A right of way across or within a block for use by pedestrian traffic, whether designated as a pedestrian way, crosswalk or however otherwise designated.
   PLAN COMMISSION: See Commission.
   PLAT: A map or drawing on which the subdivider's plan of the subdivision is presented and which he submits for approval.
   PRELIMINARY PLAN: The drawings and documents described in Chapter 3 of this Title first submitted of the proposed subdivision and subject to changes and corrections.
   PRIMARY STREET: Primary street or major street means a street of considerable continuity which serves or is intended to serve as a major traffic artery between the various sections of the Inverness area, as shown on the General Development Plan as part of the Official Plan.
   PUBLIC STREET: All primary, secondary and minor streets which are shown on the subdivision plat and which are to be dedicated for public use.
   RIGHT OF WAY: A strip of land occupied or intended to be occupied by a road, crosswalk, railroad, electric transmission lines, oil or gas pipe line, water main, sanitary or storm sewer main or for another special use. Right of way, on all future subdivisions, shall be exclusive of the lots adjoining lots or parcels, and the dimensions of the right of way shall not be included in the adjoining lots or parcels. Rights of way intended for roads or any other public use which will ultimately require maintenance by the Village or some other public body shall be dedicated to public use by the maker of the plat which establishes the right of way.
   ROADWAY: That portion of the street which is paved for vehicular traffic.
   SEWAGE DISPOSAL SYSTEM, INDIVIDUAL: A septic tank seepage tile sewage disposal system, or any other sewage treatment device approved by the Village Engineer serving only one lot or building site.
   SEWAGE DISPOSAL SYSTEM, CENTRAL: A system of sanitary sewers that discharges either into an interceptor sewer or an approved sewage treatment plant.
   STREET: In this Title, the word "street" refers to the entire width of the street right of way or easement, and shall not be considered as the width of the pavement only. See Right of Way.
   STREET PLAN: See General Development Plan.
   SUBDIVIDER: Any person who undertakes the subdivision of land as defined herein.
   SUBDIVISION: A described tract of land which is to be, or has been, divided into two (2) or more lots or parcels. The term "subdivision" includes resubdivision, and where it is appropriate to the context, relates to the process of subdividing or to the land subdivided.
   A.   For the purposes of these regulations, a subdivision of land is, or includes:
      1.   The division or subdivision of land into parcels or tracts of less than five (5) acres in size or which involves any new streets or easements of access;
      2.   The division of lots or blocks of less than one acre in any recorded subdivision which involves any new streets or easements of access;
      3.   The conveyance of parcels of land or interests therein for use as a right of way for railroads or other public utility facilities and other pipe lines which involves any new streets or easements of access;
      4.   The conveyance of land owned by a railroad or other public utility which involves any new streets or easements of access;
      5.   The sale or exchange of parcels or tracts of land following the division into no more than two (2) parts of a particular parcel or tract of land existing on July 17, 1959 and involving any new streets or easements of access;
      6.   The division of land, for single-family residential purposes, into one or more additional tracts, sites, or parcels of five (5) acres or more in area. In the event the owner of forty (40) or more acres of land within the jurisdiction of this Title proposes to create one additional building site of less than five (5) acres, he may do so without coming under the definition of "subdivision", as defined in this Title, provided that he shall obtain approval by the Plan Commission of a plan for the building sites or parcels contiguous to the one being developed, showing lot layout, circulinear road layout, and easements; provided, however, that not more than one additional building site shall be created in any twenty four (24) month period under the foregoing exception to the definition of subdivision;
      7.   The division of land for single-family residential purposes into tracts of five (5) acres or more where the proposed lot frontage is less than three hundred feet (300');
      8.   The dedication of a public road, highway, or street or the establishment of any new easement of access whether public or private, through a tract of land regardless of area;
      9.   Any sale or division of land for which a plat is required by Statute;
      10.   Any resubdivision of land heretofore subdivided or platted.
   B.   For the purpose of these regulations, a subdivision of land is or includes any condominium development, any planned development and any other residential, commercial or industrial development of two (2) or more principal buildings on one or more lots, tracts or parcels of land which affects, involves or relates to facilities (present or proposed) protecting the public health, safety and welfare or which affects, involves or relates to the need for such facilities in the future. For the purpose of this subparagraph:
      1.   "Facilities" include but are not limited to public streets, alleys, and ways for public utilities, curbs, gutters, sidewalks, street lights, parks, playgrounds, school grounds or other public grounds, storm water drainage, water supply and distribution, sanitary sewers, or sewage collection and treatment.
      2.   "Principal buildings" means buildings in which the primary activity of property is conducted and excludes permitted buildings which are ancillary to residential uses, such as garages, greenhouses, and gazebos.
   C.   For the purposes of these regulations, the term "subdivision" shall not include:
      1.   The sale or exchange of parcels of land between owners of adjoining and contiguous land;
      2.   The conveyance of parcels of land or interests therein for use as a right of way for railroads or other public utility facilities and other pipe lines which does not involve any new streets or easements of access;
      3.   The conveyance of land owned by a railroad or other public utility which does not involve any new streets or easements of access;
      4.   The conveyance of land for highway or other public purposes or grants of conveyances relating to the dedication of land for public use or instruments relating to the vacation of land impressed with a public use;
      5.   Conveyances made to correct descriptions in prior conveyances.
   THROUGH LOT: Any lot having frontage on two (2) approximately parallel streets. (1983 Code)
