4-7-2: DEFINITIONS:
The following words and terms shall, for the purpose of this chapter and as used elsewhere in this code, have the meaning shown herein:
   ABOVEGROUND/ONGROUND POOL: See definition of Private Swimming Pool. Except for hot tubs and spas, aboveground/onground pools are prohibited.
   BARRIER: A fence, a wall, a building wall, the wall of an aboveground swimming pool, or a combination thereof, which completely surrounds the swimming pool and obstructs access to the swimming pool.
   HOT TUB OR SPA: A private swimming pool with a surface area no greater than ninety six (96) square feet in the aggregate.
   INGROUND POOL: See definition of Private Swimming Pool.
   POWER SAFETY COVER: A pool cover which is placed over the water area, and is opened and closed with a motorized mechanism activated by a control switch.
   PRIVATE SWIMMING POOL: Any structure that contains water over twenty four inches (24") (610 mm) in depth and which is used or intended to be used, for swimming or recreational bathing in connection with an occupancy in use group R-3 and which is available only to the family and guests of the householder. This definition includes inground, aboveground and onground swimming pools, hot tubs and spas.
   PRIVATE SWIMMING POOL, INDOOR: Any private swimming pool that is totally contained within a private structure and surrounded on all four (4) sides by walls of said structure.
   PRIVATE SWIMMING POOL, OUTDOOR: Any private swimming pool that is not an indoor pool.
   PUBLIC SWIMMING POOL: Any swimming pool other than a private swimming pool.
   SWIMMING POOL: A receptacle for water or an artificial pool of water intended for the purpose of immersion or partial immersion therein of human beings having a depth at any point of more than two feet (2'), placed in an excavation. No swimming pool shall extend two feet six inches (2'6") or more aboveground. A "swimming pool" includes all appurtenant equipment, such as, but not limited to, pumps, filters and disinfectant equipment. (Ord. 06-822, 3-14-2006; amd. Ord. 2012-928, 8-14-2012)
