3-3-7: DENIAL OF PERMIT:
   A.   Upon the village president or the village president's designee review of the application, the village president or the village president's designee may refuse to issue a permit to the applicant under this chapter for any of the following reasons:
      1.   The location and time of solicitation or peddling would endanger the safety and welfare of the solicitors, peddlers, or their customers;
      2.   An investigation reveals that the applicant falsified information on the application;
      3.   The applicant has been convicted of a felony or class A misdemeanor, the nature of which is related to the applicant's fitness to engage in door-to-door activities under this chapter. The applicant shall be of good character and reputation without a conviction related to fraud, dishonesty, deceit, misrepresentation, sexual misconduct, trafficking in controlled substances, violent acts against persons or property, or offense involving moral turpitude;
      4.   In reviewing fitness under subsection (a)(3) of this section, the following shall be considered:
         a.   The extent and nature of the applicant's past criminal activity;
         b.   The age of the applicant at the time of the commission of the crime;
         c.   The amount of time that has elapsed since the applicant's last criminal activity;
         d.   The conduct and work activity of the applicant prior to and following the criminal activity;
         e.   Evidence of the applicant's rehabilitation or rehabilitative effort while incarcerated or following release; and
         f.   Other evidence of the applicant's present fitness.
      5.   There is no proof as to the authority of the applicant to serve as an agent to the principal; or
      6.   The applicant has been denied a permit under this chapter within the immediate past year, unless the applicant can and does show to the satisfaction of the village president or the village president's designee that the reasons for such earlier denial no longer exist.
   B.   The village president or the village president's designee disapproval and the reasons for disapproval shall be noted on the application, and the applicant shall be notified that his application is disapproved and that no permit will be issued.
