(A) Self-service stations shall have at least one attendant on duty while such station is open to the public. The attendant's primary function shall be to supervise, observe and control the dispensing of flammable liquids while such liquids are actually being dispensed.
(B) (1) It shall be the responsibility of the attendant to:
(a) Prevent the dispensing of flammable liquids into containers inappropriate for that purpose.
(b) Control sources of ignition.
(c) Immediately handle accidental spillage fire extinguishers when needed.
(d) Upon request, assist an unaccompanied physically-handicapped person in the dispensing of flammable liquid into that persons' vehicle, provided that the attendant shuts off the power to the remaining self-service dispensing devices.
(2) The attendant shall be mentally and physically capable of performing the functions and assuming the responsibilities prescribed in this section.
(C) A clearly identified and easily accessible switch or circuit breaker shall be provided at the location remote from the dispensing devices including remote pumping systems, to shut off the power to all dispensing devices in the event of any emergency. Such emergency controls shall be installed at a location acceptable to the Fire Department, but such controls shall not be more than 100 feet from the dispensing devices.
(D) Permanent signs and placards printed in not less than one-half inch block letters on a contrasting background shall be conspicuously posted at each self-service device so as to give complete and clear operational directions. Permanent signs and placards printed in not less than three inch block letters on a contrasting background shall be conspicuously posted in the dispensing areas incorporating the following or equivalent wording:
(1) WARNING — IT IS UNLAWFUL AND DANGEROUS TO DISPENSE GASOLINE INTO UNAPPROVED CONTAINERS
(2) NO SMOKING
(3) STOP ENGINE
(E) The dispensing area shall be at all times in clear view of the attendant and the placing or allowing of any obstacle to come between the dispensing area and the attendant control area shall be prohibited. The attendant shall at all times be able to communicate with persons in the dispensing area.
(F) Self-service dispensing devices shall not occupy the same pump island as attended dispensing devices. Pump islands with self-service dispensing devices shall be separated from pump islands with attending dispensing devices by a distance of not less than ten feet.
(G) No member of the public shall use or operate any flammable liquid dispensing equipment at any service station except if the service station is a licensed self-service filling station as defined in § 121.71.
