In all cases of violation of the provisions of this chapter, the owner or occupant of the buildings or premises shall remove such obstruction within 24 hours after receipt of notice to do so from any proper authority of the city. Failing obedience to remove the same, such removal shall be forthwith effected by the Director of the Department of Public Services at the expense of the owner, occupant, contractor or builder who failed to heed the notice herein provided for. Any expenses incurred by the city in effecting such removal may be recovered by the city in an action at law before a court of competent jurisdiction, The notice herein provided for shall be given to the owner or occupant, contractor or builder; and if they or either of them cannot be found, the said notice shall be securely posted in some conspicuous place on said premises or abutting building; provided, that a compliance with such notice or the removal of obstructions shall not operate to suspend the penalties of the code. Each and every day that any violation continues after notice given as above provided, until removal, the owner or occupant, contractor or builder, as the case may be, or either or all of them, may be complained of as for an original and distinct offense, and may be punished as is provided in this code.
