(A) The functions and duties of the former Indio Consolidated Appeals Board, as specified in Chapter 95 are transferred to the Enforcement Hearing Officer established by Chapter 12 of this code. Where the code makes reference to the Indio Consolidated Appeals Board, such references shall be deemed to refer to the Enforcement Hearing Officer and where such reference grants or infers functions and duties for the former Indio Consolidated Appeals Board, those functions and duties shall be deemed transferred to the Enforcement Hearing Officer.
(B) Appeals to the Enforcement Hearing Officer shall be based upon a claim that the intent or provisions of Code of Indio Chapters 93, 95A, 958, 95D, or 151 has been incorrectly interpreted or applied. The Enforcement Hearing Officer shall have no authority to waive requirements of any of these chapters.
