§ 35.35 EMPLOYEE MERIT PROGRAM.
   (A)   There is hereby established an employee merit based program. The purpose of this program is to provide an annual budget appropriation to the City Manager to be used to award those full-time, non-collectively bargained employees who have demonstrated exemplary service highlighted through the successful completion of a specific project, task or accomplishment which exemplifies the village mission and departmental goals. Annual appropriations to this program are not guaranteed.
   (B)   Any merit awarded by the City Manager shall not be based upon hourly compensation at time and one-half nor shall exempt employees lose their exempt status by participating in the program. The amount and timing of merit solely shall be within the discretion of the City Manager through recommendations from Department Heads. The employees who are eligible for the program shall be determined at the discretion of the City Manager.
   (C)   The amount of any merit and the employees who shall receive such merit may vary from year to year. Any merit awarded shall not increase the employee's base salary in the determination of annual compensation nor shall the failure to award merit or the award of a lesser amount from year to year be considered as disciplinary action or as a decrease in performance.
