§ 91.02 COMPLAINTS FILED IN WRITING WITH CITY MANAGER.
   (A)   Any person who has been injured, attacked physically, chased, or put in fear of physical harm, or whose gardens, lawns, shrubbery, or other and different property has been extensively, irreparably, or repeatedly injured or damaged by a dog or cat, may register in writing a complaint thereof with the Police Department. An adult may file such a complaint on behalf of a minor child in his care or custody. The complaint shall be in the form of a sworn affidavit and shall specify the incident complained of, the date of occurrence, a description of the dog or cat, the name and address of the owner or harborer of the dog or cat, and such other information as may reasonably be required to describe the offense complained of, and shall be signed by the person making the complaint. A form of the complaint may be prepared by the Police Department. A member of the Indian Hill Rangers shall sign and issue a summons, which shall be served in person to the alleged owner or harborer.
   (B)   Once a complaint is filed, as provided herein, the Rangers shall, when serving a copy of the complaint upon the owner or harborer, also serve a notice that the animal or animals identified in the complaint be restricted in the same manner as provided in § 91.05. Once the notice is served, the owner or harborer shall restrict the animal in the same manner as provided in § 91.05 until the complaint is disposed by Mayor's Court. Each occasion that an owner or harborer fails to restrict an animal as provided herein shall constitute a separate offense. Where the owner or harborer of an animal which has been restricted in accordance with this subsection or § 91.04 owns or harbors more than one animal subject to this chapter, each subsequent occasion that the owner or harborer fails to restrict such animal, whether or not it is the same animal previously restricted, shall be a separate offense. An owner or harborer failing to restrict their animals as provided herein shall be subject to the penalties provided in § 91.99.
