§ 90.08 FALSE ALARMS.
   (A)   The Chief of Police shall keep an accurate record of all false alarms.
   (B)   An alarm system shall constitute a public nuisance if it activates more than three false alarms in any 360-day period. Each false alarm record will be eliminated on the 360th day after that false alarm.
   (C)   When the holder of a permit for an alarm system activates more than three false alarms in a 360 day period, a $15 responding fee shall be charged to that holder for each of the fourth and fifth false alarms.
   (D)   For the sixth false alarm in a 360- day period a $30 responding fee shall be charged to the holder.
   (E)   The seventh false alarm of the alarm of a holder in a 360-day period constitutes an offense and will result in the issuance of a citation to Mayor's Court.
   (F)   Subscribers shall keep their alarm system in good repair.
   (G)   Subscribers and permittees shall notify the Police Department prior to any service, test, repair, maintenance, adjustment, alteration, or installation which might activate a false alarm.
   (H)   Each false alarm in excess of three in any 360-day period shall constitute a separate responding fee.
      (1)   For the first false alarm within a 360-day period, the Police Department will advise the permittee in writing that the false alarm has occurred and recommend that appropriate steps be taken to prevent future occurrences.
      (2)   Upon the occurrence of a second false alarm within a 360-day period, the Police Department will send a second written communication to the permittee advising of the false alarm and of the consequence of continued false alarms.
      (3)   Upon the occurrence of the third false alarm in a 360-day period, the Police Department will cause a Police Officer to contact the permittee to attempt to correct the situation and to advise the permittee that a fourth false alarm within a 360-day period will result in a fee being imposed.
      (4)   Upon the occurrence of the fourth, fifth and sixth false alarms, the Police Department will serve the permittee an invoice for the responding fee specified in divisions (C) or (D) of this section.
      (5)   Upon the occurrence of the seventh false alarm, the Police Department shall issue a citation to the permittee as specified in division (E) of this section.
   (I)   The first false alarm of an alarm system for which there is no valid permit outstanding shall constitute a responding fee being levied as prescribed in division (C) of this section.
