796.99 PENALTIES.

For the first offense of any Operator who violates or fails to comply with any of the provisions of this Chapter, the Mayor shall send to the Operator a letter warning the operator that any future violation will lead to citation in accordance with the provisions herein. Any Operator who violates or fails to comply with any of the provisions of this Chapter, following the issuance of a warning letter, shall be guilty of a minor misdemeanor and fined not more than two hundred and fifty dollars ($250.00) for a second offense. Whoever shall be convicted of a violation of this Chapter for a second or subsequent offense shall be guilty of a misdemeanor of the fourth degree and shall be fined not more than five hundred dollars ($500.00). Each day of violation shall constitute a separate offense.
