193.98 SAVINGS CLAUSE; INTENT TO CONFORM TO OHIO REVISED CODE.
   (A)   If any sentence, clause, section or part of this chapter, or any tax imposed against, or exemption from tax granted to, any taxpayer or forms of income specified herein is found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality, or invalidity shall affect only such clause, sentence, section or part of this chapter so found and shall not affect or impair any of the remaining provisions, sentences, clauses, sections or other parts of this chapter. It is hereby declared to be the intention of the legislative authority of the Municipality that this chapter would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included in this chapter.
   (B)   It is the intent of Council, in adopted this Chapter 193, that Chapter 193 conform to all of the requirements of ORC Chapter 718 as of January 1, 2006. Each provision of Chapter 193 shall be construed such that it does not conflict with ORC Chapter 718 as it existed on the date of this Ordinance 2015-20, including any changes enacted as of the date of this Ordinance that are scheduled to take effect on or before January 1, 2016, even if this requires that a provision of Chapter 193 that appears to conflict with ORC Chapter 718 be treated as a scrivener's error. The Law Director and the Finance Director shall promptly advise Council of any legislative change, or of any court or administrative decision, that might cause or indicate a conflict between ORC Chapter 718 and this Chapter 193, and shall recommend to Council any necessary amendments to keep Chapter 193 in conformity with ORC Chapter 718. (Ord. 2015-20. Passed 9-8-15.)
