775.01 FEE ESTABLISHED.
   (a)   In accordance with the requirements of Ohio R.C. 1332.32, all video service providers providing video service in the City pursuant to a video service authorization obtained from the Director of the Ohio Department of Commerce (“providers”) shall pay no video service provider fees (“VSP fees”), totaling zero percent (0%) of gross revenues received from providing video service in the City.
   (b)   Although the City will not charge a VSP fee to any providers, the City hereby reserves its right to charge a VSP fee, not to exceed five percent (5%) of gross revenues, in the future.
   (c)   If, at any time in the future, the City chooses to exercise its reserved right to charge a VSP fee to providers, the City shall pass an ordinance charging the VSP fee at a specified rate and shall provide written notice to the providers, within reasonable time, regarding the same.
   (d)   As used in this section, “gross revenues” shall be defined by Ohio R.C. 1332.32(B)(1) and shall include advertising revenues, as defined by Ohio R.C. 1332.32(B)(2)(g).
   (e)   The Mayor is hereby authorized and directed, upon receipt of notice from a provider that it intends to begin providing video service in the City, to submit to such provider written notice of the City’s decision to not charge VSP fees at this time, as determined by this section, which notice shall be delivered in a manner that shows proof of timely delivery.
