161.05 UNDERPAYMENT AND OVERPAYMENT OF FINES AND COURT COSTS.
   (a)   Except as set forth in subsection (b) hereof, the Clerk shall not accept waiver payments from any person in an amount that is less than, or greater than, the amount owed. The Clerk shall immediately return the underpayment or overpayment to the sender with notification to resubmit the proper amount immediately.
   (b)   The Clerk may accept a waiver payment from any person in an amount that is less than, or greater than, the amount owed, provided said underpayment or overpayment is de minimus. The Clerk’s acceptance of an underpayment or overpayment shall constitute full payment of the waiver amount, and in cases involving overpayment, the Clerk shall not refund the de minimus overpayment. For purposes of this subsection (b), de minimus shall mean an amount of one dollar ($1.00) or less.
