1541.02 ENFORCEMENT AND INSPECTION; EQUITABLE REMEDIES.
(a) The provisions of this chapter shall be enforced by the Fire Chief or Municipal Fire Safety Inspector. The Fire Chief or Municipal Fire Safety Inspector or his or her designee is authorized to inspect any dwelling or building to determine whether the requirements of this chapter have been complied with. If the Fire Chief or Municipal Fire Safety Inspector determines that the requirements of this chapter have not been complied with, he or she shall issue written notice of such violation to the owner or person in charge of such dwelling or building, which notice shall inform the owner that such owner has ten days to correct such violation. No owner or person in charge of any dwelling or building shall refuse to allow the inspection of the premises by the Fire Chief or Municipal Fire Safety Inspector or his or her designee for purposes of ensuring compliance with this chapter.
(b) Whenever any person fails, neglects or refuses to comply with any order of the Fire Chief or Municipal Fire Safety Inspector under the provisions of this chapter, the Fire Chief or Municipal Fire Safety Inspector may, at his or her discretion, institute and maintain in the name of the Municipality an appropriate action at law or in equity to restrain the execution in violation of this chapter and to prevent or terminate any violation of this chapter.
