1531.05 ENFORCEMENT; INSPECTIONS; EQUITABLE REMEDIES.
   (a)   The provisions of this chapter shall be enforced by the Fire Chief or Municipal Fire Safety Inspector. The Fire Chief or Municipal Fire Safety Inspector or his or her designee shall be authorized to inspect any hotel or motel to determine whether the requirements of this chapter have been complied with and to determine that the automatic fire detection and alarm devices required by this chapter are approved, properly installed and properly maintained. If the Fire Chief or Municipal Fire Safety Inspector determines that the requirements of this chapter have not been complied with, he or she shall issue written notice of such violation to the owner or person in charge of such hotel or motel, which notice shall inform the owner that such owner has thirty days to correct such violation. No owner or person in charge of a hotel or motel shall refuse to allow inspection of the premises by the Fire Chief or Municipal Fire Safety Inspector or his or her designee for purposes of ensuring the proper installation and continued maintenance of the automatic fire detection and alarm devices.
   (b)   Whenever any person fails, neglects or refuses to comply with an order of the Fire Chief or Municipal Fire Safety Inspector under the provisions of this chapter, or whenever any existing hotel or motel is used or occupied so as to be in violation of or not in conformity with any provision of this chapter, the Fire Chief or Municipal Fire Safety Inspector may, at his or her discretion, institute and maintain in the name of the Municipality an appropriate action at law or in equity to restrain the execution in violation of this chapter, to prevent the occupation or use of such existing hotel or motel and to prevent or terminate any violation of this chapter.
