1501.03 ENFORCEMENT.
The BOCA Basic Fire Prevention Code, as revised, as adopted herein, shall be enforced by the Municipal Fire Safety Inspector.
(a) No person shall serve as Municipal Fire Safety Inspector unless he has received a certificate issued by the Ohio Superintendent of Public Inspection, under Ohio R.C. 3303.07, evidencing his satisfactory completion of a fire safety inspection training program.
(b) Upon examination or inspection, the Municipal Fire Safety Inspector shall issue citations if he finds conditions specified in Ohio R.C. 3737.41, which are especially dangerous to the safety of persons, buildings, premises or property, and he shall make any necessary remedial orders in connection therewith. Citation enforcement may be the procedures established in Ohio R.C. 3737.42 for hearing on the citation or Ohio R.C. 3737.44 for injunctive relief or temporary restraining order and oral order for vacation of the building or premises.
(c) Upon reliable belief following inspection or investigation, the Municipal Fire Safety Inspector shall, with reasonable promptness, issue a citation to the responsible person for a violation of the Ohio Fire Code, or any order issued by the Ohio Fire Marshall or any municipal fire safety inspector. The citation shall fix a reasonable time for the abatement of the violations.
(d) A report of the Bureau of Fire Prevention shall be made annually and transmitted to the Mayor; it shall contain all proceedings under this Code, with such statistics as the Chief of the Division may wish to include therein; the Chief of the Fire Division shall recommend any amendments to the Code which, in his judgment, would be desirable.
