1353.01 REQUIREMENT BEFORE PERMIT ISSUANCE.
   (a)    The Inspector of Buildings is hereby authorized and directed not to issue a permit for any building unless he has first ascertained that a septic tank and filter bed and a system of drainage can be installed to meet in all respects the requirements and specifications of the County Board of Health and municipal ordinances and that the effluent from such filter bed and drainage system will be discharged into an existing watercourse by means of a drainage sewer which has been built to line and grade in accordance with a plan prepared by a registered professional engineer. This may be a sewer heretofore constructed by the State Department of Highways, the County, by the Municipality or by a person; provided, however, that the use for such discharge has not been expressly prohibited by such public agencies.
   (b)    If the Inspector finds that such an outlet, as provided in subsection (a) herein, does not exist, he shall report such facts to the Mayor and Council. After the Mayor and Council have received such a report from the Inspector, they may order the building permit not to be issued or determine what construction must be made before the permit may be issued.
