1349.04 WORK WITHIN CITY RIGHTS OF WAY OR EASEMENTS.
(a) Any person desiring to perform any work within the City’s rights of way or easements shall contact the Building Department for all necessary permits. All contractors must be licensed by the City before any work can begin on any project.
(b) All persons who have been issued a permit by the City shall notify the City Engineer/Public Service Coordinator, Service Director and Chief of Police in writing of any proposed construction or work no less than seventy-two hours before start of said work. All projects shall have full plans and scope of work descriptions approved by the City Engineer/Public Service Coordinator prior to the start of any work. The City reserves the right to require any work to be performed during non-peak or evening hours depending on the propose work location.
(c) At such times as dictated by the City Engineer/Public Service Coordinator, a City Inspector shall be required at all projects while working within any City right-of-way. The cost of the City Inspector shall be the sole responsibility of the person who has been issued a permit.
(d) All trenches shall be compacted and disturbed areas shall be regraded with a minimum four inches of topsoil spread and sodded.
(e) All persons shall replace, in kind, any existing structure damaged through construction including trees and/or shrubbery and seeding.
(f) All persons shall be solely responsible to determine and locate all existing underground utilities which may be affected during the construction.
(g) Any trenches under an existing pavement, sidewalk or driveway shall be backfilled with premium backfill such as limestone, slag or crushed concrete screenings, or flowable controlled density fill, or in any other reasonable manner as determined by the City Engineer/Public Service Coordinator.
(h) Any pavement, including street aprons, drives, or walks, that is removed shall be done on a joint to joint removal basis.
(i) At least one lane of traffic shall remain open at all times during construction.
(j) Independence Police or approved flagmen shall be utilized to direct traffic, as required. All traffic control shall comply with the Ohio Manual of Uniform Traffic Control Devices.
(k) Any person violating any provision under this section shall be guilty of a third degree misdemeanor. Each day a person violates any provision under this section shall constitute a separate offense.
