1161.03 PERMISSION TO EXCEED ESTABLISHED HEIGHT.
   The Board of Zoning Appeals may, after public notice and hearing and subject to such conditions and safeguards as the Board may prescribe to protect the appropriate use of neighboring property, permit the erection of a building or portion of a building covering not more than twenty-five percent of the area of the lot to a height in excess of the limits prescribed in Sections 1161.01 and 1161. 02, or may permit the erection of any other structure in excess of the limits prescribed in Sections 1161.01 and 1161.02, which permission shall be confirmed by resolution of Council before becoming effective. The Board shall treat any such request to exceed the height limitations as a variance from the Zoning Code and it shall make specific findings of fact as required by the Charter and ordinances before granting any such variance.
