959.01 SERVICE ESTABLISHED; QUALIFICATIONS.
   (a)   General.
      (1)   The snow removal service set forth in this ordinance is within the City’s sole discretion and only after, as determined by the Service Director, there has been at least a four-inch snowfall locally and all necessary public highway and street snow removal has been completed.
      (2)   The snow removal service provided for in this section shall consist of a standard size snow plow making two passes on the resident’s driveway for the purpose of emergency entrance and egress.
      (3)   A resident who fails to qualify under this ordinance may apply to the Community Services Department for snow plow services based upon a hardship, provided the non-qualifying resident reimburses the City for the actual cost the City incurs for the snow removal.
   (b)   The Service Department, upon the terms and conditions stated herein, and under such other rules and regulations established by the Service Director that are consistent herewith and necessary in order to carry out the provisions and intent of this section may provide driveway snow removal to a residence within the Municipality whose occupants qualify as follows:
      (1)   Senior Citizens. All occupants living in the home must certify that they are at least sixty (60) years of age or older. Proof of age and residency may be required.
      (2)   Disabled Persons Under Age 60. All occupants living in the home under the age of 60 must provide medical documentation annually that they are disabled due to a physical or mental impairment, and certify that they do not live with an individual capable of snow removal. For permanent disabilities, a notice of social security or veteran’s administration disability statement must be provided to the City and remain on file.
      (3)   Deployed Active Military Personnel. Resident homeowner living in the home is on active military duty and deployed for any branch of the United States Armed Services during the time snow removal is to be provided and that active duty is for a period of not less than fifteen (15) consecutive days.
      (4)   Any resident who violates subsections (1), (2) or (3) hereof, shall immediately be disqualified from any further services provided herein, and shall be precluded from registering with the City to receive such services in the future for a period of three (3) calendar years.
      (5)   Any qualifying senior/disabled person/deployed active military personnel requesting snow removal service under this ordinance shall register with the Community Services Department annually after October 1st of each calendar year, and at the time of registration shall:
         (i)   Pay a nonrefundable service fee of twenty-five dollars ($25.00) in order to assist in defraying the costs of administration and service. Residents who meet eligibility criteria and are on HEAP shall receive the service at a discounted rate of fifteen dollars ($15.00). A non-refundable sedrvice fee shall be paid at the time of registration by residents qualified to participate under this section, as follows:
Households with residents eligible under this section in more than one of the above categories shall be charged the lower fee per registration. Proof shall be required.
         (ii)   Certify to the eligibility requirements as set forth herein.
         (iii)   Execute a consent and release, in a form approved by the Law Director, granting permission to and exonerating the City from any and all liability for providing such snow removal service.
      (6)   Any resident who violates subsection (5)(ii) hereof shall be required to submit payment for costs actually incurred by the City. Failure to provide payment immediately shall result in disqualification from any further services provided herein, and shall be precluded from registering with the City to receive such future services until the account balance is paid in full.
