931.03 TAP-IN CHARGE FOR USE OF SAN FERNANDO CIRCLE IMPROVEMENTS.
(a) It is hereby found and determined that each parcel of property which abuts the public right of way known as San Fernando Circle will be benefitted in the approximate amount of $31,469.36 as a result of the City’s improvement thereof.
(b) Upon the City’s improvement of San Fernando Circle, no person or owner of any property that abuts San Fernando Circle shall make a connection to any of the water mains, storm sewers, or sanitary sewers thereon until the owner of the property from which the connection is to be made has paid to the Finance Director the amount set forth in subsection (a) hereof as a tap-in charge and which specific amount shall be confirmed and certified by the City Engineer within 30 days from the completion of said improvements.
(c) If any owner of property abutting San Fernando Circle has not paid the tap-in charge within six months from the date on which the City Engineer certifies the amount due, then interest at the rate of 6% per year shall accrue on the tap-in charge from and after such date.
(d) All funds which the Finance Director receives as tap-in charges pursuant to this section are intended solely to reimburse the City for the costs which were advanced for the construction of the San Fernando Circle improvements.
(e) Upon receipt of the above-described tap-in charges, the Finance Director shall deposit them into the appropriate account in order to reimburse the City for the funds advanced for the construction of the San Fernando Circle improvements.
