761.01 SALE OF MERCHANDISE OUTSIDE OF A BUILDING.
   (a)   No person shall display or sell merchandise or other property on private land within the Municipality except within a permanently constructed building unless a permit has been granted by Council. However, merchandise produced on the premises, nursery stock or used cars may be displayed or sold in the open so long as such use of land is not in violation of the Planning and Zoning Code.
   (b)   This section shall not apply to activities directly related to Halloween, Thanksgiving or Christmas. In those instances where a person applies for such a permit, the Building Inspector may issue a permit if he determines that the sale of such merchandise is not in violation of the Planning and Zoning Code and that the issuance of the permit would not result in any condition stated in Section 761.02. The Building Inspector may impose such reasonable conditions as may be necessary to satisfy such criteria and to protect the public peace, health, safety and welfare. Any permit issued under this subsection shall expire no later than three months from the date of issue.

   (c)   Notwithstanding subsection (a) and (b) hereof, any resident of the Municipality is permitted to sell and/or display in the open (i. e. not within a permanently constructed building) one used car, of which he is the owner, upon satisfaction of the following conditions:
      (1)   The resident obtains a permit for such sale and/or display from the Building Official, which permit is effective for thirty days and may be renewable for an additional thirty days upon written approval of the Building Official. (Ord. 2014-17. Passed 5-13-14.)
      (2)   The resident has not sold and/or displayed in the open any other used car within a one-year period from the date that the above described permit is requested. (Ord. 1995-41. Passed 11-2-95.)
