660.27 COMMERCIAL GARBAGE PICKUP, DUMPSTERS AND RECEPTACLES.

   (a)    Any commercial property within the City shall provide an enclosure for garbage dumpsters and receptacles so as to conceal the garbage dumpsters, receptacles and specific area used for garbage collection. The enclosure shall have a gate or door which shall be kept closed at all times.

   (b)    The height and type of such enclosure shall be determined by the Architectural Review Board. If, as a result of its review and consideration, the Architectural Review Board establishes a required height that would be in excess of that permitted by ordinance, the applicant will not be required to seek a variance from the Board of Zoning Appeals.

   (c)    The location of such dumpsters and receptacles shall be at a distance which is closer to the commercial building serviced by the dumpster than to any abutting residential dwelling.

   (d)    The hours for garbage collection from commercial property abutting residential property shall be limited to after 8:00 a.m. and before 6:00 p.m., Monday through Saturday.

   (e)    Whoever violates any provision of this section or participates in such a violation, shall be guilty of a misdemeanor of the fourth degree for the first offense. Punishment shall be as provided in Section 698.02.
