620.06 RESPONSIBILITIES OF PARTIES DOING BLASTING.
   (a)    Every contractor shall comply with all Federal, State and Municipal laws governing storage, sale, transportation and use of explosives.
      (1)    Contractor. The contractor shall use every reasonable precaution to provide for the safety of all employees on the job and of such other persons who may be legally entitled to be on such job as well as the safety of the public and it shall be the duty of such contractor to comply with the provisions of this chapter.
      (2)    Superintendent. A superintendent to whose attention the existence of any unsafe or illegal condition is called, shall take immediate steps to remedy or remove the unsafe or illegal conditions.
      (3)    Employee and other persons.
         A.    Every employee shall observe all of the provisions of this chapter which directly concern or affect his conduct and no person shall willfully permit a violation of this chapter.
         B.    No person shall knowingly use explosives for blasting purposes in an unsafe or illegal manner.
         C.    All persons having knowledge of the existence of an unsafe or illegal condition shall promptly report the same to the superintendent.
      (4)    Blaster. The blaster shall not use and detonate explosives unless the requirements of this chapter have been observed and every reasonable precaution, not specifically set forth in this chapter, has been taken to prevent accidents, damage to property or unreasonable disturbance.
      (5)    Exceptions. Construction work involving use of explosives for blasting purposes for which contracts have been signed or authorized prior to the effective date of this chapter should comply with this chapter.
   (b)    Both a contractor and subcontractor whose work involves the use of explosives for blasting purposes on a construction project shall comply with these rules and regulations and neither shall be saved harmless because of the errors of omission or commission of the other.    (c)    Whoever violates or fails to comply with any of the provisions of this section is guilty of a misdemeanor of the third degree. Punishment shall be as provided in Section 698.02. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
