620.041 ANNUAL BLAST SURVEY.
   (a)   Within ninety days after the enactment of this section, and annually thereafter, the blaster shall perform and provide to the Municipal Engineer a blast survey on all dwellings, structures and/or property located within a one-half mile radius of the blasting site.
   (b)   Within ninety days after the enactment of this section, and annually thereafter, the blast survey shall be conducted as follows:
      (1)   At least thirty days prior to, but no more than sixty days prior to the performance of the blast survey. The blaster shall notify, in writing, all residents or owners of dwellings, or structures and/or property located within a one-half mile radius of the blasting site, about the procedure involved in requesting a blast survey. Such notification shall be sent by way of U.S. certified mail, return receipt requested and shall include information on how the annual blast survey will be conducted and completed. A copy of all annual blast notifications shall be sent to the office of the Municipal Engineer.
      (2)   Any resident or owner of a dwelling, structure and/or property within a one-half mile radius of the blasting site may request to participate in the annual blast survey conducted by the blaster. This request shall be made in writing directly to the blaster, with a copy sent to the Municipal Engineer, or his or her designee within thirty days after notice of the annual blast survey is received. The blaster shall conduct an annual blast survey of the dwellings, structures, and/or property of the resident or owner making the annual blast survey request and prepare a written report of the survey.
      (3)   Only individuals reasonably acceptable to the Municipal Engineer shall conduct the annual blast survey.
      (4)   The annual blast survey and written report shall be conducted, and be prepared, in a manner reasonably acceptable to the Municipal Engineer. The written report of each blast survey shall include, but is not necessarily limited to, the blaster’s opinion as to the condition of the dwellings, structures and/or property of the resident or owner, and shall document any adverse impact or other physical factors existing on the date of the survey that could reasonably be attributed to the blasting.
      (5)   The annual blast survey written report shall be signed by the person who conducted the blast survey. The original report shall be filed with the Municipal Engineer’s office and a copy shall be provided by the blaster to the resident or owner requesting the blasting survey.
      (6)   If a resident or owner disagrees with any portion of the blast survey written report he or she may submit a written description as to the areas of disagreement to the Municipal Engineer with a copy to the blaster, within thirty days following the receipt of the blast survey written report by the resident or owner.
