606.25 DISPOSITION OF PROPERTY HELD BY POLICE DEPARTMENT; LAW ENFORCEMENT TRUST FUND.
   (a)    Any property that has been seized in relation to a violation of Ohio R.C. 2933.42 and any contraband in the custody of the Police Department that is subject to the provisions of Ohio R.C. 2933.43 shall be held and disposed of pursuant to Ohio R.C. 2933.43 and any other procedure provided by law. Any other property that has been lost, abandoned, stolen, seized pursuant to a search warrant or otherwise lawfully seized or forfeited, and that is in the custody of the Police Department, shall be held and disposed of pursuant to Ohio R.C. 2933.41 and any other procedure provided by law.

   (b)    The Finance Director is hereby authorized and directed to establish a separate fund which shall be known as the Law Enforcement Trust Fund. Moneys resulting from the retention, sale or other disposition by the Police Department of contraband forfeited pursuant to Ohio R.C. 2933.43(c) shall be deposited in the Fund after payment of the charges set forth in Ohio R.C. 2933.43(D)(1) through (D)(3). Moneys from the Fund shall be allocated by the Council to the Police Department only, and shall only be expended for any one or more of the following purposes:
      (1)    To pay the costs of protracted or complex investigations or prosecutions;
      (2)    To provide reasonable technical training or expertise;
      (3)    To provide matching funds to obtain Federal grants to aid law enforcement;
      (4)    For such other law enforcement purposes as the Council determines to be appropriate.
   A minimum of ten percent (10%) of the first one hundred thousand dollars ($100,000) of moneys held in the Fund and a minimum of twenty percent (20%) of the moneys exceeding one hundred thousand dollars ($100,000) in the Fund shall be allocated and used solely for providing reasonable technical training or expertise for the Police Department. The Department shall adopt a written internal control policy governing the use of proceeds received from the Fund and shall annually submit to the Ohio Attorney General a cumulative report of the receipts and general expenditures of such proceeds.

   (c)    Any and all moneys that result from the retention, sale or other disposition of property by the Police Department and that do not qualify for deposit in the Law Enforcement Trust Fund shall be deposited in the General Fund.
