315.11 NEWSPAPER CARRIERS.
   (a)    Every person delivering newspapers shall wear a vest, coat or other garment approved by the Chief of Police and made of red, fuchsia or orange material with the property of reflecting light. The vest, coat or other garment shall:
      (1)    Contain a minimum of 144 square inches of red, fuchsia or orange material with the property of reflecting light between the neck and waist of its front;
      (2)    Contain a minimum of 144 square inches of red, fuchsia or orange material with the property of reflecting light between the neck and waist of its back; and
      (3)    Be worn as the outermost garment during hours of twilight and darkness.
   (b)    Subsection (a) hereof shall not apply to a person driving a motor vehicle while delivering newspapers if such person does not alight from the motor vehicle.

   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
