§ 92.03 ALCOHOLIC BEVERAGES.
   No person shall possess, transport, or consume any alcoholic beverages except under one of the following conditions:
   (A)   By permit issued by the Michigan State Liquor Control Commission; or
   (B)   By permit issued by the city for a private, not for profit, gathering. Application for the permit shall be filed at least one week before the date of the gathering on a form to be approved by the City Manager. The applicant shall be responsible for posting the permit in a conspicuous place at the gathering and for the maintenance of order at the gathering and no such alcoholic beverage may be bought or sold at the gathering. Issuance of a permit to an applicant does not relieve the applicant or any other person or organization of the obligation to comply with all applicable state laws and local laws. The application may be denied if, in the opinion of the City Manager and the Public Safety Director, that the gathering:
      (1)   Will present a clear danger to the safety of the residents of the city.
      (2)   Will be so large as to render the enforcement of the applicable state and local laws impossible.
   (C)   An applicant who is denied a permit under this section may appeal the action directly to the City Commission.
