§ 91.08 VIOLATION; NOTICE.
   In addition to the penalty set forth in § 91.99(A), if any dog shall be found running at large within the corporate limits of the city in violation of § 91.02, the dog shall be taken into custody by the city police officer or other law enforcement officer or any other person authorized by the City Commission by resolution to carry out the terms of §§ 91.01 through 91.07. If the dog bears no identification by appropriate tag attached to the collar of the dog, the dog shall be impounded for four days and if not claimed within this period it shall be killed, sold, or otherwise disposed of. Should the dog bear an appropriate identification tag on its collar, the owner of such tag shall be notified forthwith, either personally or by notice to the residence of the owner, by first class United States Mail, postage fully prepaid, and the owner shall pay $5 for each day that the dog is in custody to the City Clerk and upon such payment the dog shall be released to the owner. If such payment is not made, the dog shall be sold, killed, or otherwise disposed of. Any dog not claimed within ten days of service of the aforesaid notice shall be sold, killed, or otherwise disposed of. Service is complete when notice is mailed or personally served.
