§ 95.01 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   “AUTOMATED PACKER REFUSE COLLECTION SYSTEM.” A system whereby garbage and rubbish is collected by city refuse crews utilizing automated machinery to manipulate containers specifically designed and engineered for use in conjunction with the automated machinery and provided to the property owners by the city.
   “COLLECTION SITE.” Each residence located within the city limits shall have a “COLLECTION SITE” for materials to be collected by the city under this chapter, which site shall be on, or as near as reasonably possible to that residences’ property and at ground level within five feet of a street right-of-way and easily accessible for city collection personnel, except as otherwise expressly and reasonably designated by the Street Department. If served by an Automated packer Refuse Collection System the collection site shall be as provided in § 95.08 of this chapter.
   "CONTAINERS."
      (1)   With regard to garbage and/or rubbish, containers are receptacles constructed of heavy-duty material with lids sufficient to inhibit the entry of water and with handles of sufficient strength to bear the content's weight while being lifted; heavy-duty plastic bags which are securely tied to facilitate handling and filled no more than six inches from the top; closed cardboard boxes and closed paper sacks which are not water-soaked; and rubbish, compostables, or recyclables susceptible to being bundled which are securely bundled and tied, such as newspapers, tree limbs and brush.
      (2)   With regard to compostables, containers are to be of compostable material as reasonably determined by the Street Department (for yard waste paper bags, and paper and cardboard boxes which do not contain dyes or chemical components which would be detrimental to the city's composting program).
      (3)   With regard to recyclables, containers are only recycling bins, bags, or other containers furnished through or approved by the city's waste recycling program.
      (4)   Further, no “CONTAINERS” shall:
         (a)   Have a capacity of more than 33 gallons,
         (b)   Weigh more than 50 pounds,
         (c)   Have a volume of more than 24 cubic feet, or
         (d)   Be more than four feet in its longest dimension, three feet in its next longest dimension, and two feet in its third dimension.
   “COMPOSTABLES.” All leaves, grass, brush, limbs, and similar vegetable matter, yard waste and compostable containers then accepted in the city's composting program as provided in a duly adopted policy of the Board of Public Works and Safety of the city.
   "COUNTY" or "HUNTINGTON COUNTY." For the purposes of this chapter only, “COUNTY” or “HUNTINGTON COUNTY” shall mean the geographic boundaries of Huntington County and that portion of the incorporated Town of Markle, Indiana, which is located in Wells County, Indiana.
   "GARBAGE." All accumulated food waste products and other matter resulting from the preparation, use, or cooking of food, including but not limited to food and beverage containers which are not recyclables.
   "LANDFILL LABEL." The Board of Public Works and Safety shall, from time to time, determine the particulars of a landfill label to be affixed to containers of garbage and rubbish for collection in accordance with § 95.04 .
   “RECYCLABLES.” All metal, plastic, glass, paper, and other items then accepted in the city's waste recycling program, clean and separated by categories and otherwise in accordance with the city code and those then in force policies as are adopted and published as legal notices from time to time by the City Board of Public Works and Safety.
   "RUBBISH." Solid waste material then accepted at the city's solid waste disposal facilities, such as ashes, cans, wastepaper, broken boxes, litter, building materials, furniture, fixtures, and appliances and appliance components incidental to domestic or business use, excluding, however, garbage, recyclables, and compostables.
