No building permit shall be issued by the city to any person, firm or corporation desiring to construct, reconstruct or structurally alter or repair any retaining wall on property abutting open waterways or bodies of water, including but not limited to canals, lakes and waterways, within the city, unless the applicant for such permit has complied with the provisions of this subchapter.
