1321.02 APPLICATION INFORMATION.
   (a)   (1)   An application for a Certificate of Occupancy required by the provisions of this Code for all multifamily units with more than four dwelling units and commercial buildings with residential tenant space shall be made annually to the Building Department not later than January 15 of each year, in writing, by supplying the information and date to determine compliance with applicable laws, ordinances, rules and regulations for the existing use or occupancy or the intended use or occupancy. Such application shall be made on forms supplied by the CBO or his/her designee and shall be accompanied by the fee required by the provisions of this Code and found in Section 105.08.
      (2)    The CBO may require the submission of an affidavit stating such information, and he or she may cause a general inspection of the structure or premises to be made.
      (3)    Applications for a Certificate of Occupancy for all single-family, two-family, three- family and four-family dwellings and condominiums, hotels and motels shall be made every year in accordance with the provisions of this section.
   (b)    If it is found that a building or other structure is in compliance with the provisions of this Code and all other laws, ordinances, rules and regulations applicable thereto, the CBO or his/her designee shall issue a Certificate of Occupancy for such building or structure which shall contain the following information:
      (1)    The street address or other identifying characteristics of the building or other structure;
      (2)    The name and address of the owner, and, if the owner does not reside on the premises, the name and address of the resident agent in charge of the building or structure, and the name and address of the nonresident agent, if any;
      (3)    The exact nature and extent of the use or occupancy authorized;
      (4)    The period for which such Certificate of Occupancy is issued;
      (5)    Other information deemed pertinent by the Building Commissioner and/or the Building Department Manager for the purposes of this section.
   (c)    The CBO shall have the power to revoke a Certificate of Occupancy if any false statement is made by the owner in connection with the issuance of such Certificate, for noncompliance of a structure or its use with the requirements of this Code, or if the owner, agent or person in charge of a structure refuses to comply with any provision of this Code required to be observed by him or her.
   (d)    Upon written request to the trustees or officers of any condominium association, said association shall provide a list of those condominium units in the association that are being rented from or otherwise not occupied by their current legal owner. The association shall additionally provide a name and current address of the owner(s) and occupant(s) of all said condominium units.
   (e)    An owner must register any multiple dwelling or residential rental unit which is not owner-occupied with the Building Department within seventy-two hours after obtaining legal possession of the property. When a structure has been owner-occupied and becomes vacant, the owner must make application to register the structure within ninety days and include a statement from the owner giving the date the structure was vacated. Such registration of non-owner occupied property must include the name, address and phone number of the designated janitor, custodian, agent or operator of the multiple dwelling or residential rental property.
