12-4-8: CONSTRUCTION:
   A.   Standards And Specifications: Improvements required and/or regulated by this title shall be constructed in accordance with the following (where and if the provisions of these documents conflict, the stricter of the regulations shall apply):
      1.   Adopted engineering drawings and specifications.
      2.   "Standard Specifications For Road And Bridge Construction", IDOT, latest edition.
      3.   "Standard Specifications For Water And Sewer Main Construction", latest edition.
      4.   Standards, requirements and regulations set forth in this title.
      5.   Other applicable ordinances of the village.
   B.   Responsibility For Costs: All required improvements shall be made by the developer, at the developer's expense, without reimbursement by the village; except, that as may be allowed under state law, the developer may form or cause to be formed a special district or districts to construct and finance the construction of required public improvements, excluding lot developments on individual lots. If the subdivider does form or cause to be formed a special district for the purposes identified in this subsection, the village shall not release the subdivider from its obligations under any subdivision improvement agreement nor shall the village release any security, in whole or in part, until the special district has sold bonds or otherwise certifies to the village that it has an absolute right to raise revenues sufficient to construct, maintain, and warrant the quality of the required public improvements.
   C.   Commencement Of Construction:
      1.   Construction may commence only after the engineering drawings and specifications have been approved by the village engineer and the subdivider has received a letter from the village engineer formalizing said approval.
      2.   Construction shall not commence until all required permits are obtained, all fees are paid to the permitting agencies and to the village, and all the required forms have been submitted and approved. See subsection 12-4-3H of this chapter.
      3.   The subdivider shall furnish the village public works superintendent two (2) sets of engineering drawings and specifications prior to commencement of any construction operations.
      4.   Construction performed prior to approval of the final plat shall be at the risk of the subdivider.
      5.   If construction of the improvements was commenced prior to approval of the engineering drawings and specifications, the developer shall pay a penalty fee as provided in section 12-3-4 of this title.
   D.   Development Schedule: A development schedule shall be submitted to the village engineer prior to commencement of construction. As events warrant, an updated schedule shall be resubmitted to the village engineer. The development schedule should indicate the following:
      1.   The approximate date when construction of the project can be expected to begin.
      2.   The stages in which the project will be built and the approximate dates when construction of each stage can be expected to begin.
      3.   The approximate dates when the development of each of the stages in the development will be completed.
      4.   The area and location of common open space that will be provided at each stage.
   E.   Modifications:
      1.   If, in the course of construction, the subdivider wishes to significantly modify (as determined by the village engineer) the size, type, quality, quantity and/or location of any or all of the improvements required or regulated by this title, the subdivider's engineer shall submit a written change request to the village engineer for review and written approval prior to proceeding with installation of the modified improvement.
      2.   Minor field changes, based upon field conditions, that do not impact the suitability or performance of the improvements shall not require advance review of the village engineer.
      3.   Verbal requests shall be followed by written documentation within two (2) days.
   F.   Construction Observation And Testing:
      1.   Construction Observation:
         a.   The degree of engineering observations during actual construction operations (as contrasted with preparatory and cleanup operation, for example) shall be one hundred percent (100%) during storm sewer, sanitary sewer, water main, force main, and pavement construction. The observation shall be performed by the developer's engineer or by a person working under the direction of the developer's engineer. All construction shall be performed in accordance with the approved engineering drawings and specifications, with an observer present as stated herein, or the village engineer shall recommend stopping all construction operations.
         b.   The observation by the developer's engineer shall be adequate to ensure that all work complies with the standards and specifications listed in subsection A of this section.
         c.   The village public works superintendent shall perform daily construction observation or as necessary to ensure that storm sewer, sanitary sewer, water main, force main, and pavement construction is performed in compliance with the standards and specifications listed in subsection A of this section.
         d.   The village engineer shall perform weekly observation or as necessary to ensure that storm sewer, sanitary sewer, water main, force main, and pavement construction is performed in compliance with the standards and specifications listed in subsection A of this section.
      2.   Construction Testing:
         a.   Tests required by this title shall be performed solely by independent testing laboratories, the subdivider's engineer or qualified personnel employed by the subdivider's engineer, and shall be performed at the subdivider's expense.
         b.   The sampling frequency and basis of construction testing shall be in conformance with the "Project Procedures Guide", IDOT, latest edition.
         c.   The subdivider shall direct that the results of required tests be mailed or delivered to the village engineer immediately upon completion of the tests and that no test results be withheld from the village.
   G.   Time Periods For Construction: The subdivider shall complete construction of all subdivision improvements in accordance with the approved drawings and specifications within two (2) years of the date the village approves the final plat of the subdivision. At the subdivider's request, the board of trustees may extend the time period in which to complete the construction for an additional one year if the board of trustees finds that such an extension is consistent with the public welfare.
