(a) The commission of a parking infraction as contained herein shall not be a criminal offense but shall constitute a civil matter subject to fines and other punishment as contained herein.
(b) Ticket Citation. The parking ticket form or citation in which a person is cited with a parking infraction shall be upon such form as adopted by the Village of Hebron Police Department from time to time. Such ticket or citation shall be the summons and complaint.
(c) Waiver/Payment of Fine. Any person charged with a violation of any provision of this chapter for which payment of a prescribed fine may be made, may pay such sum in the manner prescribed on the issued ticket. Such payment shall be deemed a plea of guilty, waiver of court appearance and acknowledgment of conviction of the alleged offense and may be accepted in full satisfaction of the prescribed penalty for such alleged violation. Payment of the prescribed fine may not be accepted when the ordinances prescribe that a certain number of such offense shall require court appearance.
(d) Hearing. Any person charged with the violation of any provision of this chapter may request and shall be entitled to a hearing on the matter. The matter shall be heard by the Magistrate of the Village of Hebron Mayor’s Court, or such other person as the Mayor may designate to hear such matters. The matter shall be heard at the next session of Mayor’s Court or such later date as the issuing officer shall designate, and such date and time shall be noted on the ticket/citation.
(e) Penalty and/or Fines. The penalty and/or fine for violation of this chapter shall be noted on the attached schedule of fines. (Ord. 23-09. Passed 1-27-10.)
Whenever any police officer finds a vehicle unattended upon any street, bridge or causeway, or in any tunnel, where such vehicle constitutes an obstruction to traffic, such officer may provide for the removal of such vehicle to the nearest garage or other place of safety.
