It shall be unlawful for any person to consume or possess any open containers of any alcoholic beverage on any public place, street or alley in the City of Heath, Texas.

It shall be unlawful for any person to consume any alcoholic beverage on any public place adjacent to any street or alley in the City of Heath, Texas.

The Director of the Department of Public Safety or other police officers of the City of Heath, Texas, or any peace officer within the limits of the City of Heath, Texas, or any peace officer within the limits of the City of Heath, Texas, may arrest without warrant any person who violates the terms of this chapter and the officer or person making the arrest is justified in adopting all of the measures which he or she might adopt in cases of arrest under warrant provided further that in all cases of arrest without warrant, the officer making the arrest shall immediately take the person arrested before the nearest or most accessible Magistrate having jurisdiction.
