§ 150.01  PERMIT FEES.

BUILDING CODE; STANDARDS OF SAFETY
§ 150.10  ADOPTION OF UNIFORM STATE BUILDING CODE; PLUMBING CODE; STANDARDS OF SAFETY; AND 2012 INTERNATIONAL PROPERTY MAINTENANCE CODE.
   (A)   Pursuant to KRS 198B.060(8), a building inspection program is hereby established in the city for application to all buildings, including single-family dwellings as provided in the adopted codes.
   (B)  The Kentucky Building Code and Kentucky Residential Code, as contained in Chapter 7, Title 815, §§ 120 and 125 of the Kentucky Administrative Regulations; the Kentucky Plumbing Code, as contained in Chapter 20, Title 815 of the Kentucky Administrative Regulations; the Kentucky Standards of Safety, as contained in Chapter 10, Title 815 of the Kentucky Administrative Regulations, and 2012 International Property Maintenance Code/1996 together with any amendments, are hereby adopted by reference as if fully set forth in this code of ordinances.  Copies of the above codes and any amendments thereto shall be placed on file in the office of the City Manager or other authorized city official where they shall be available for public inspection during normal business hours.
   (C)  Each of the codes adopted in division (B) of this section, including all penalty provisions thereof and including any amendments thereto, shall be in force throughout the city.

§ 150.11  ENFORCEMENT OF CODES.
   (A)  The Building Inspector shall enforce the provisions of the Kentucky Building Code, the Kentucky Residential Code, and the 2012 International Property Maintenance Code as the same may be hereinafter in effect within this jurisdiction.  All building code inspections shall be performed by persons certified by the Kentucky Department of Housing, Buildings and Construction.  All electrical inspections shall be performed by a certified electrical inspector specifically approved by this jurisdiction. Appeals by persons aggrieved by decisions of the Building Inspector shall be governed by § 150.20.
   (B)  The State Plumbing Inspector shall enforce the provisions of the State Plumbing Code.  Appeals by persons aggrieved by decisions of the State Plumbing Inspector shall be governed by state law.
   (C)  The Fire Chief shall enforce the provisions of the State Standards of Safety.  Appeals by persons aggrieved by decisions of the Fire Chief shall be governed by state law.

ADMINISTRATION
§ 150.20 APPEALS.
   Any person affected by a notice, order or decision of the Building Inspector or other code official under the Kentucky Building Code, the Kentucky Residential Code or the International Property Maintenance Code shall have the right to appeal to the Code Enforcement Board established pursuant the Hazard Code of Ordinances, provided that a written application for appeal is filed within 20 days after the day the decision, notice, or order was served.  An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or the requirements of this code are adequately satisfied by other means.

§ 150.99  PENALTY.
   Any person who violates any provision of the state codes adopted in § 150.10 shall be subject to the following penalties:
   (A)   Except as otherwise set forth herein, violators of the Kentucky Building Code or Kentucky Residential Code shall, upon conviction, be subject to a fine of not less than $10, nor more than $1,000, for each offense.  (KRS 198B.990(1))
   (B)   Any person who fails to comply with the assurances required under KRS 198B.060(10)(a), upon such finding by a court of competent jurisdiction, shall be fined an amount not to exceed $4,000 or an amount equal to the sum of all uninsured and unsatisfied claims brought under the provisions of KRS Chapter 342 and unemployment insurance claims for which no wages were reported as required by KRS Chapter 341, whichever is greater.  The penalty imposed in KRS 198B.060(10) shall be enforced by the County Attorney for the county in which the violation occurred.

   (C)   Violators of the State Standards of Safety shall, upon conviction, be subject to a fine of not less than $25 nor more than $1,000, imprisonment for not more than 60 days, or both for each offense.  (KRS. 227.990(1))
   (D)   Violators of the State Plumbing Code adopted in § 150.10 shall, upon conviction, be subject to a fine of not less than $10 nor more than $100, imprisonment for not more than 90 days, or both for each offense.  (KRS 318.990)
   (E)   Violators of the 2012 International Property Maintenance Code shall be subject to a civil penalty of not less than $25, nor more than $100, for each offense.
