5-4-2: DOGS:
   A.   Owner Defined: For the purpose of this section "owner" means a person having a right of property in a dog, or who keeps or harbors a dog, or who has in his care or acts as guardian for a dog, or who normally permits a dog to remain on or about any premises occupied by him.
   B.   Female Dog In Heat: The owner of any female dog in heat shall keep the dog confined in a secure enclosure during such period.
   C.   Dangerous Dog: A "dangerous dog" is hereby defined to be a dog which shall cause annoyance or reasonable fear of bodily injury to any person by attacking or threatening to attack such person. The owner of any dangerous dog shall keep said dog confined in a secure enclosure or on a leash controlled by the owner or his agent at all times.
   D.   Dog On Leash: No owner of any dog shall permit such dog, except when on a leash controlled by the owner or his agents, to be upon any public street, walk, parkway or public area within the village and no leash shall be longer than eight feet (8') in length 1 . The provisions of this subsection shall not apply to dogs leading blind persons.
   E.   Prohibited Acts And Conditions:
      1.   Damage To Property: No owner of a dog shall, without the consent of the owner of the property concerned, permit such dog to enter upon the premises of another or to injure, destroy or carry away any vegetable, plant, fruit, shrub, tree, flower or other thing which may be on said premises within the village.
      2.   Barking Dog: No owner of a dog shall permit such dog, by prolonged or loud barking, to disturb the peace and welfare of any person.
      3.   Biting Dog: No owner of a dog shall permit such dog to bite, scratch or otherwise injure any person who is peaceably conducting himself in any place where he may lawfully be. (Ord. 315-81, 5-12-1981; amd. 1995 Code)
      4.   Collar With Proof Of Rabies Inoculation: No person shall bring a dog into the Village unless the dog has been inoculated as provided by 510 Illinois Compiled Statutes 5/8. All dogs must also have a durable collar with a current metallic tag signifying a rabies inoculation securely attached thereto.
   F.   Penalty: The violation of any of the provisions of this section, except subsection E4 of this section, shall be punishable as provided in subsection 1-4-4E of this Code; in addition thereto, and upon conviction for such a violation, such defendant shall be assessed all costs and reasonable attorney fees incurred by the Village in enforcing the provisions of this section against such defendant 2 . Any person violating subsection E4 of this section shall be subject to penalty as provided in section 1-4-1 of this Code for each offense. A separate offense for violation of any of the provisions of this section shall be deemed committed on each day during or on which the violation occurs or continues. (Ord. 947-01, 6-18-2001)
