3-3-4: LICENSING REQUIREMENTS:
   A.    State Permit And City License Required; Fees:
      1.    A licensed organization may not conduct lawful gambling at any site unless it has first obtained from the gambling control board, state of Minnesota, a premises permit for the site. (1996 Code)
      2.    No bingo occasion shall be conducted except by an eligible organization which has secured a license for that purpose, as provided in this section. (Ord. 165, 12-8-1980)
      3.    A single occasion license shall be valid for twenty four (24) calendar months from the date of issuance. (Ord. 165, 12-8-1980; amd. 1996 Code)
      4.    The single occasion license fee shall be in an amount shown in section 3-8-1 of this title and may be amended by the council from time to time. (Ord. 246, 12-3-2007)
      5.    A license application shall be acted upon by the city council no sooner than thirty (30) days and no later than one hundred eighty (180) days after the date of the application.
      6.    No bingo license issued may be transferred to any other person or organization. No bingo license shall be transferred to any location other than the location specified in the license, without prior approval of the city council. (Ord. 165, 12-8-1980)
   B.    Application For License: Every application for a bingo license shall be made to the city administrator on a form supplied by the city and containing such information as the city administrator or the city council may require. No person shall make a false statement in an application. Copies of each application shall be referred to the city's police chief, fire chief, and city council/building committee for their recommendations. Each application approved will be forwarded to the state gambling board for final approval.
   C.    Term Of License; Suspension Or Revocation: Licenses issued under this section are valid for two (2) years and may be suspended by the state gambling board for a violation of law or state gambling board rule or revoked for what the board determines to be a wilful violation of law or board rule. A revocation or suspension is a contested case under sections 14.57 to 14.69 of the administrative procedure act.
   D.    Inspection And Investigation: Any city official or employee, having a duty to perform with reference to a bingo license, and any police officer may inspect and examine the bingo records of any licensed organization upon twenty four (24) hours' notice. (Ord. 165, 12-8-1980; amd. 1996 Code)
