4-1-1: BUILDING CODE ADOPTED:
   (A)   The city adopts by public ordinance the current edition of the building code and all accompanying appendices, amendments and modifications as adopted by the building codes bureau, Montana department of labor and industry applicable to local government jurisdictions, subsequent editions of building codes may be adopted by administrative action as authorized by Montana Code Annotated section 50-60-301(1)(b); as published in ARM section 8.70.1501 and sections 24.301.202, 24.301.901 through 24.301.905. The building code is applicable to all buildings within the city limits. (Ord. 852, 2-21-2006)
   (B)   The adopted building code(s) shall regulate the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in the city and its jurisdictional area and provide for issuance of permits and collection of fees and penalties. 4-1-5: BUILDING OFFICIAL:
The "building official" provided for in the model technical code shall be the city director of public works. (Ord. 852, 2-21-2006)
4-1-6: BOARD OF APPEALS:
The "board of appeals" provided for in the model technical code shall be the board of adjustment of the city established in subsection 11-1-19(A) of this code. Board powers and appeal procedures are provided in section 11-1-19 of this code. (Ord. 852, 2-21-2006)
4-1-7: ISSUANCE OF SUBPOENA:
Failure to respond to a subpoena duly issued by the board of appeals shall be a misdemeanor. (Ord. 746, 2-2-1987)
4-1-8: VIOLATION A MISDEMEANOR:
It shall be unlawful and a misdemeanor, punishable by a fine of up to five hundred dollars ($500.00), imprisonment up to six (6) months, or both, for any person to violate any provision of the codes adopted by this chapter or any provision of any rule or regulation adopted by the building official pursuant to authority granted by this chapter. Each day's failure to comply with any such provision shall constitute a separate violation. (Ord. 746, 2-2-1987)
4-1-9: CONFLICTING PROVISIONS:
In any case where a provision of this chapter is found to be in conflict with the provision of any zoning, building, fire, safety or health regulation or code of the city existing on the effective date of this chapter, the provision which establishes the higher standard for the promotion and protection of the health and safety of the people shall prevail. In any case where a provision of this chapter is found to be in conflict with a provision of any other regulation or code of the city, existing on the effective date of this chapter, which establishes a lower standard for the promotion and protection of the health and safety of the people, the provisions of this chapter shall be deemed to prevail, and such other regulations or codes are hereby declared to be repealed to the extent that they may be found in conflict with this chapter. If any section, subsection, paragraph, sentence, clause or other phrase of this chapter, or of the codes adopted herein, should be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this chapter, which shall remain in full force and effect, and to this end the provisions of this chapter are hereby declared to be severable.
